Privacy policy

1. Data controller
DIGITAL ADVISORY SOLUTIONS LLC (EIN 32-0807349), 500 4th St NW, Suite 102, Albuquerque, NM 87102, United States. Data protection contact: legal@tunotariaonline.org.
As an entity established outside the European Union offering services to EU residents, we apply Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). [Pending: appointment of an EU representative under Art. 27 GDPR.]
2. Data we process
- Identity and contact data: name, surname, DNI/NIE, address, phone, email.
- Procedure data: document type, parties involved, documentation provided and draft content.
- Payment data: handled by Stripe; we only receive payment confirmation and the last card digits.
- Browsing data: IP address, device and cookies, as described in the Cookie policy.
- Communications: messages exchanged via WhatsApp, email or form.
3. Purposes and legal basis
- Handling your request, preparing the quote and providing the contracted service (performance of contract, Art. 6(1)(b) GDPR).
- Coordinating the appointment with the notary and sending them the required documentation (performance of contract and legal obligation, Art. 6(1)(b) and (c)).
- Invoicing and tax and commercial obligations (legal obligation, Art. 6(1)(c)).
- Answering enquiries via WhatsApp, email or form (legitimate interest / consent, Art. 6(1)(f) and (a)).
- Web analytics and advertising through cookies, only if you accept them (consent, Art. 6(1)(a)).
- Sending you communications about our services, only with your express consent (Art. 6(1)(a)).
4. Who we share your data with
With the registered notary who authorises your document, to the extent necessary. With service providers acting as processors under contract:
- Typeform (request forms).
- Meta Platforms (WhatsApp Business) for customer support.
- Google (Workspace for email, Tag Manager and Analytics).
- Stripe (payment processing).
- Web hosting providers.
5. International transfers
The controller is established in the United States and several processors handle data outside the EU. These transfers rely on the Standard Contractual Clauses approved by the European Commission and, where applicable, the EU-US Data Privacy Framework. You can request a copy of the safeguards at legal@tunotariaonline.org.
6. How long we keep your data
Procedure data is kept for the duration of the contractual relationship and for six years afterwards to meet commercial and tax obligations and possible liabilities. Data from enquiries that do not lead to a contract is deleted after 12 months. Browsing data is kept for the periods stated in the Cookie policy.
7. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction and portability, and withdraw consent at any time, by writing to legal@tunotariaonline.org with proof of identity. You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
8. Security
We apply technical and organisational measures to protect your data: encryption in transit, access control, minimisation of information shared with third parties and staff training. Signing takes place on the official notarial platform, with identification by qualified digital certificate.
9. Minors
Our services are aimed at people aged 18 or over. We do not knowingly process data of minors.
10. Changes
We may update this policy to reflect legal or service changes. The current version is always the one published on the Site, with its update date.
